Terms of Service

These Terms of Service (“Terms”) are an agreement between you and NOVATOPIA LABS LIMITED (“NOVATOPIA”, “we”, “us” or “our”), a company registered in Hong Kong. By downloading, installing, accessing or using ZenDefend Ad Blocker (the “Service”), you agree to these Terms. If you do not agree, do not use the Service.

1. The service

ZenDefend Ad Blocker provides local-first, domain-level filtering intended to block known advertising, tracking and malicious domains on supported devices. The Service may include desktop software, mobile applications, rule lists, account services, license management, support and updates.

2. Eligibility and account

You must be legally able to enter this agreement. If you use the Service for a company, household or another person, you confirm that you have authority to accept these Terms on their behalf. Keep account credentials and device access secure, and notify us if you believe an account has been used without permission.

3. License and acceptable use

Subject to payment of applicable fees and compliance with these Terms, we grant you a limited, non-exclusive, non-transferable and revocable license to use the Service on the number and type of devices stated in your plan.

• Do not use the Service to attack, probe, overload or interfere with networks, systems or accounts you do not own or have permission to test.
• Do not use the Service to facilitate fraud, malware distribution, harassment, unlawful surveillance or infringement of another person’s rights.
• Do not reverse engineer, resell, sublicense or bypass license limits except where applicable law expressly permits it.
• Do not represent ZenDefend as a network security guarantee or use it as the sole control for safety-critical systems.

4. What the blocker can and cannot promise

Domain-level filtering cannot reliably remove advertising or sponsored content when it shares a domain, encrypted connection or delivery stream with wanted content. The Service does not promise that every ad, tracker, YouTube ad, in-stream ad or visual page element will be blocked. Compatibility may vary by operating system, network configuration, application and rule-list update.

5. Purchases, subscriptions and refunds

Prices, plan limits, taxes, billing periods and renewal terms are shown at checkout. Payments may be processed by Waffo Pancake or another payment provider identified at checkout. A payment provider may collect and process payment information under its own terms and privacy policy.

If a plan renews automatically, the checkout flow will identify the renewal interval and cancellation method. You may cancel future renewal using the method shown in your account or by contacting support. Cancellation does not necessarily reverse a completed charge. Refund eligibility is governed by the refund policy displayed at checkout and applicable law.

6. Updates and availability

We may update rule lists, applications and supporting services. An update may change compatibility or filtering behavior. We may suspend or limit a feature to address security, abuse, legal or operational issues. We do not guarantee uninterrupted availability.

7. Third-party services

The Service may interact with operating-system services, app stores, payment providers, hosting providers, DNS resolvers and other third parties. Their terms, availability and policies apply to their services. We are not responsible for third-party changes outside our reasonable control.

8. Intellectual property

ZenDefend, its software, designs, documentation and related materials are owned by NOVATOPIA or its licensors. These Terms do not transfer ownership to you. Feedback you provide may be used to improve the Service without creating an obligation to pay you.

9. Disclaimer and limitation of liability

To the maximum extent permitted by law, the Service is provided on an “as available” and “as is” basis. We disclaim warranties that are not expressly stated in these Terms. To the maximum extent permitted by law, NOVATOPIA will not be liable for indirect, incidental, special, consequential or punitive losses, or loss of data, profits or business opportunity arising from use of the Service. Nothing in these Terms excludes liability that cannot legally be excluded.

10. Termination

You may stop using the Service at any time. We may suspend or terminate access if you materially breach these Terms, create security or legal risk, or fail to pay amounts due. Provisions that by their nature should survive termination will survive, including payment obligations, intellectual property, disclaimers and limitations of liability.

11. Consumer privacy and regional rights

European Economic Area, United Kingdom and Switzerland

Where the GDPR, the UK GDPR or equivalent Swiss data-protection law applies to your use of the Service, you may have rights to access, rectify, erase, restrict or object to processing, data portability and to lodge a complaint with your local supervisory authority. We process personal data only on a documented legal basis, provide information about processors and international transfers in the Privacy Policy, and do not make solely automated decisions that produce legal or similarly significant effects through the Service.

Nothing in these Terms limits mandatory consumer rights under applicable law. To exercise a privacy right, contact support@zendefend.net; we may request reasonable identity verification and normally respond within the period required by applicable law.

California and other US state privacy rights

If the California Consumer Privacy Act as amended by the CPRA or another US state privacy law applies, you may have rights to know or access, correct, delete, opt out of sale or sharing, limit certain sensitive-personal-information uses and receive equal service. ZenDefend is not intended to sell personal information. We do not knowingly use sensitive information for cross-context behavioral advertising. Requests may be submitted to support@zendefend.net; authorized-agent requests must include legally required proof.

12. Governing law and contact

These Terms are governed by the laws stated in the final version approved for publication by NOVATOPIA. Before public launch, the company should insert its selected Hong Kong governing-law and dispute-resolution language after legal review.
